Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Dial A Pilot mobile application (the "App") operated by Dial A Pilot, LLC ("Dial A Pilot," "we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Description of Service
Dial A Pilot is a fear-of-flying application that provides educational aviation content, turbulence information, flight tracking features, guided audio exercises, and access to a community of users. The App is designed for informational and educational purposes for anxious fliers.
Dial A Pilot is an independent company and is not affiliated with, endorsed by, sponsored by, or acting on behalf of any airline, air carrier, aircraft manufacturer, or aviation authority, including but not limited to any commercial, regional, or charter airline. Content provided through the App reflects the general knowledge and experience of aviation professionals and is not a substitute for official aviation safety information from airlines, the FAA, or other regulatory bodies.
3. Account Registration
To access certain features of the App, you must create an account. You agree to: (a) provide accurate and complete information; (b) maintain the security of your account credentials; (c) notify us immediately of any unauthorized use of your account; and (d) accept responsibility for all activity that occurs under your account.
You may register using your email address or Apple Sign In. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions and Purchases
4.1 Subscription Plans
Access to premium features of the App requires a paid subscription. Subscription plans and pricing are displayed at the time of purchase within the App. Current plans include monthly and annual auto-renewing subscriptions, as well as a single-flight pass option.
4.2 Auto-Renewal
Subscriptions automatically renew at the end of each subscription period unless you cancel at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
4.3 How to Cancel
You may cancel your subscription at any time through your iPhone or iPad Settings: tap your Apple ID, select Subscriptions, find Dial A Pilot, and tap Cancel Subscription. Cancellation takes effect at the end of the current billing period; you will retain access until then. Deleting the App does not cancel your subscription.
4.4 Free Trials
We do not currently offer free trials. All subscription purchases provide immediate access to premium features upon confirmation of payment.
4.5 Refunds
All purchases are processed by Apple through its App Store. Refund requests are subject to Apple's refund policy and must be submitted through Apple. We do not have the ability to issue refunds directly. To request a refund, visit reportaproblem.apple.com.
4.6 Price Changes
We reserve the right to change subscription pricing. We will provide reasonable notice of any price changes. Your continued use of the App after a price change takes effect constitutes your acceptance of the new price.
5. Acceptable Use
You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:
Use the App for any fraudulent or unlawful purpose
Share, resell, or sublicense access to the App or your account credentials
Attempt to reverse engineer, decompile, or disassemble any part of the App
Post or transmit content in the community features that is defamatory, harassing, hateful, obscene, or otherwise objectionable
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Upload or transmit viruses or any other malicious code
Interfere with or disrupt the integrity or performance of the App or its underlying infrastructure
6. Community Features
The App includes community features ("Community") where users can interact with one another. You are solely responsible for any content you post in the Community. We reserve the right, but not the obligation, to monitor, edit, or remove any content that we determine in our sole discretion violates these Terms or is otherwise objectionable.
By posting content in the Community, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the operation of the App.
7. Intellectual Property
All content in the App, including but not limited to text, graphics, logos, audio files, video content, and software, is the property of Dial A Pilot, LLC or its content licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any App content without our express written permission.
8. Disclaimers
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
DIAL A PILOT DOES NOT WARRANT THAT: (A) THE APP WILL BE UNINTERRUPTED OR ERROR-FREE; (B) FLIGHT OR TURBULENCE INFORMATION PROVIDED WILL BE ACCURATE, COMPLETE, OR TIMELY; OR (C) ANY CONTENT IN THE APP CONSTITUTES PROFESSIONAL AVIATION, MEDICAL, OR PSYCHOLOGICAL ADVICE.
Flight turbulence data and flight status information are provided for informational purposes only and may not reflect real-time or actual conditions. Always rely on official sources and airline communications for safety-critical flight information.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIAL A PILOT, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR YOUR CURRENT SUBSCRIPTION PERIOD; OR (B) ONE HUNDRED DOLLARS ($100.00).
10. Indemnification
You agree to indemnify, defend, and hold harmless Dial A Pilot, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the App; (b) your violation of these Terms; or (c) your violation of any third-party rights.
11. Termination
We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, limitation of liability, and indemnification.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
13. Apple App Store Additional Terms
Your use of the App downloaded from the Apple App Store is also subject to Apple's App Store Terms of Service. You acknowledge that: (a) these Terms are between you and Dial A Pilot, LLC only, and not with Apple; (b) Apple has no obligation to provide maintenance or support for the App; (c) Apple is not responsible for any product liability claims; and (d) Apple is a third-party beneficiary of these Terms and may enforce them against you.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date and provide notice within the App. Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you should stop using the App and cancel your subscription.
